Court rules no jurisdiction to cancel or modify Israel treaty

The Court of Administrative Justice on Tuesday said it has no jurisdiction to consider a lawsuit demanding the repeal or amendment of the peace treaty between Egypt and Israel.

The court said is does not have jurisdiction over questions related to sovereignty.

The lawsuit requested that Egypt and Israel renegotiate the appendices relating to the security of the Sinai Peninsula, as the agreement allows only 750 unequipped border guards and police to be present there. The claim suggested that this allows militant groups to carry out terrorist acts and compromises the security of the country, such as the attack on a checkpoint in Rafah that killed 16 Egyptian soldiers.  

Israel has attacked Egyptian soldiers more than once, the lawsuit noted, and most recently killed seven soldiers in August 2011, in breach of Article 3 of the agreement.

It further requested that all international agreements should be reviewed, especially as the 25 January revolution overthrew the regime that signed them. Many in Egypt began calling for repealing the peace treaty signed with Israel after the toppling of President Hosni Mubarak.

Israel has frequently voiced fears of possible changes in Egypt’s foreign policy after Islamist parties won a majority of seats in Parliament and the Muslim Brotherhood’s Mohamed Morsy won the presidency.
